The following purchase terms used have the following meanings:

LIAKO: The record label company providing products on the website.
BUYER: individual user acquiring products via the website.

 

LIAKO AND THE BUYER AGREE:

Article 1: In General

These purchase terms apply to all orders placed by the BUYER with LIAKO, at records.liako.eu. By using this website you are agreeing to follow and abide by our terms and conditions and privacy policy. You agree that at any time LIAKO may change the product. In order to place an order, you must be over 18 years of age and you have to be an authorised user of the credit or debit card used to make your purchase and have sufficient funds to cover the cost of the goods. LIAKO retains the right to refuse any request made by you. When placing an order you undertake that all details you provide to us are true and accurate and it is your responsibility to inform us of any changes to these details as soon as possible.

Article 2: Terms Of Purchase

By placing an order you are offering to purchase a product on and subject to the following purchase terms. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays or force majeure for which we will not be responsible.

Article 3: Our Contract

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order. This email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us for the purchase of the goods will not be formed until your payment has been approved by us and we have debited your credit or debit card.

Article 4: Pricing Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this website are accurate, errors may occur. If we discover an error in the price of any goods, which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Where applicable, prices are inclusive of VAT. Delivery costs will be charged in addition, such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.

The products may contain typographical errors or other errors or inaccuracies and may not be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to refuse to fill any orders that you may place based on information on the products that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, purchase terms, or return policies.

Article 5: Payment

The purchase terms apply in Euro (€) currency per project and exclude VAT. Tax is applied under Belgium Law (21%).

Upon receiving your order we carry out a standard pre-authorisation check on your payment card to ensure there are sufficient funds to fulfil the transaction. Goods will not be dispatched until this pre-authorisation check has been completed. Your card will be debited once the order has been accepted.

b) Banking transfer payment

The agreed deadline is 10 days prior to purchase date. Any work, including any consultation, or delivery of information after the first contact will be the object of remuneration. Any changes made during the contract by the customer to the nature or complexity of the work and any change in use may result in a revision of the initial remuneration. The total amount due must be paid before the shipping process.

The process of payment transfer can take up to three days. Once the payment received an email will be sent to the CLIENT with the purchase confirmation whether it is a downloadable product or a physical shipping good.

Article 6: Delivery & Shipping Costs

LIAKO delivers mainly in Europe. For international delivery you shall Shipping costs are calculated according to the weight and destination, it is automatically added when validating your shopping cart, and included in the total price to pay for your order. Your estimated delivery date is in your order confirmation email – please allow until this date for your order to arrive. For shipping outside of Europe, please contact us. For Belgium, Delivery is within 5 working days* from the moment we receive the payment. Delivery is Monday to Friday (excluding Sunday and Public Holidays).

LIAKO agrees to complete the Order within 30 days from the day following the Order validation. Exceeding the shipping delay may result in a cancellation of the order as long as the order is not shipped from our warehouses. To cancel your Order, send us an email. If you still receive the package, ask for a refund of your order. As soon as we have confirmation that your package is returned, we will refund you within 15 days.

*We aim to meet these delivery times but during busy periods (including sale) deliveries may take a little longer.

Article 7: Returns And Changes

You have the right to cancel your purchases within a period of 14 calendar days after the day of delivery of the goods, without giving any reason. The goods have to be unused and undamaged, with any labels or tags intact. Returns that are damaged, soiled, washed, altered or worn (other than to try the item on) may not be accepted and may be sent back to the customer and/or a refund refused. If you want to exercise your right of return, you must:

You have 7 calendar days from the receipt of the Return form to return the goods.

All items returned should include the completed Return form with an order reference number and your contact details. Unidentified returns may not be eligible for a refund.

To return the goods you must send the product back, to LIAKO address.

The return transport fees are to be paid by the BUYER.

If the BUYER uses this withdrawal right within 14 days after receipt of the products, the LIAKO agrees to refund the BUYER without delay and no later than 30 days from the date on which this right has been exercised.

Instead of receiving a refund for your purchase, you also have the option to return and exchange an item. Similarly, you must send us an email in order to ask for a Return form and follow the above steps. You must also indicate your replacement choice. Please be aware that we can only replace it for the same product in the same or other size, subject to availability.

Article 8: Receipt – Quality – Complaints

The BUYER shall be presumed to have taken delivery of the Products within 14 days of the initially agreed upon delivery date. Thereafter, the BUYER shall be presumed to have accepted the Products with all possible defects apparent therein.

All items returned should include the completed return form with an order reference number and your contact details. Unidentified returns may not be eligible for a refund.

To return the goods you must send the product back, to LIAKO address.

The BUYER shall bear all risks concerning the return of any products until it finally arrives at the address of LIAKO.

Any claimed defect must be established by evidence. The returned item must be intact in its original packaging. If traces of the product having been used our found on the product, we will not replace the product. For defective items LIAKO will make a full refund to you, including for return shipping, as soon as possible. Where possible, we will offer to repair defective items. If it cannot be repaired or the same product is not available, you are entitled to a full refund including for shipping and return. If you would like to exchange a defective item instead of obtaining a refund, please be aware that we can only replace it for the same product in the same size, subject to availability.

Article 9: Attribution of jurisdiction

The parties agree that in case of a dispute that may arise concerning the implementation or interpretation of the purchase terms, they should try to find a compromise. In case of failure of this attempt of amicable resolution of the dispute, the latter shall be referred to the jurisdiction court.

These purchase terms will be governed by the laws of Belgium and by using the website you agree to submit to the exclusive of the courts of Belgium. The courts of Brussels are competent only.
